    An Arkansas judge has dismissed a murder charge against a 37-year-old father who admitted to fatally shooting the man accused of r*ping and later kidnapping his 13-year-old daughter after authorities revealed crucial dash camera footage may have been lost by law enforcement.

    Aaron Spencer had been facing second-degree murder in the October 2024 shooting death of 67-year-old Michael Fosler. Prosecutors alleged Spencer forced Fosler's vehicle off the road before shooting him. Spencer has maintained he acted to protect his daughter after discovering she was again with Fosler, who was already facing dozens of sexual assault charges involving the girl.

    The case collapsed after a iudge ruled that law enforcement's handling of potentially exculpatory video evidence was so egregious that dismissa was warranted. The missing memory card may have captured the shooting, and the court found no comparable evidence exists.

    Spencer, who has since launched a campaign for county sheriff, has repeatedly arqued that the justice system failed his daughter before he took matters into his own hands.
